Terms of Use

1. Application of Terms and Conditions

These terms and conditions apply to the use of any services (hereinafter referred to as the “Services”) provided on the travel website (URL: https://47trip.com/) (hereinafter referred to as this “Site”) operated by G-Plan Inc. (hereinafter referred to as “the Company”, “we”, “our”, “us”). All users (hereinafter referred to as “User(s)”) who access the Site and/or use the Services provided are subject to these terms and conditions. By accessing the Site and/or using the Services, Users shall be deemed to have agreed to these terms and conditions.

2. Revision of Terms and Conditions

The Company reserves the right to revise these terms and conditions at its discretion.

If we make any changes to these terms and conditions in accordance with the immediately preceding paragraph, we will notify Users by posting the revised terms and conditions and their effective date on the Site.

By accessing the Site and/or using the Services after the effective date of the revised terms and conditions, Users shall be deemed to have agreed to the revised terms and conditions.

3. Notes Regarding the Services

The Services provide information and the like about travel products and services from our partners and affiliates ("Partner Companies"), as well as information about travel products and services provided by us and BIGLOBE Inc. on the sites “Daredoko (https://travel.gpoint.co.jp/daredoko/)” and “Oyutabi (https://oyutabi.biglobe.ne.jp/)”. The information originates from reviews originally written in Japanese about accommodation facilities by members who have registered to our G-Point service. The Company grants these members G-Points in return for their reviews. We carefully select reviews deemed to be helpful for Users outside of Japan and translate them into other languages to be provided as travel information (“Travel Information”) on the Site.

The Company only provides Travel Information through the Site and/or Services. All actions taken by the User, including viewing or collecting information from the Site and/or the Services, or any other activities on Partner Companies’ websites or services or the like shall be at the User's sole risk and responsibility. In addition, the Travel Information is personal opinions of each individual reviewers, and we take no responsibility whatsoever for its accuracy or truthfulness.

The application and approval procedures for travel products and services provided by Partner Companies through the Site and/or Services shall be conducted directly between Users and Partner Companies. If a contract is established through these procedures, there will be a direct contractual relationship between the User and the Partner Company, and there will be no contractual relationship between the Company and the User.

4. Prohibited Conduct

When using the Site and/or Services, Users must not engage in any acts that fall under, or that may fall under, any of the following items:

(1) Violating any laws or regulations or the like, or judgments, decisions, determinations or orders or the like of any courts, regulatory agencies, or other public institutions that have the authority to regulate the Company and/or any Partner Company, or any conduct violating public order and standards of decency

(2) Infringing on any intellectual property rights, including, without limitation, copyrights, trademark rights, and patent rights, of the Company, any Partner Companies, any other Users, or any third parties

(3) Violating any rights, including, without limitation, property rights, privacy rights, publicity rights, and image rights, of the Company, any Partner Companies, any other Users, or any third parties

(4) Discriminating against or slandering the Company, any Partner Companies, any other Users, or any third parties, or promoting unfair discrimination against others, including, without limitation, slandering a specifically named region, or damaging their reputation or trust

(5) Transmitting, posting, or writing any harmful computer programs or information or the like, including, without limitation, viruses

(6) Copying, modifying, editing, translating or adapting all or any part of the Site and/or any system which provides any Services, or creating any derivative works

(7) Violating any provision of these terms

(8) In addition to the preceding items, conducting any acts that we reasonably deem to be inappropriate

If the Company determines that a User’s conduct falls under any of the categories listed above, the Company may suspend and/or terminate the User's use of all or any part of the Site and/or Services. The Company will not be responsible for any damages or disadvantage or the like caused to the User due to or in relation to any such suspension and/or termination.

5. Modifications and Suspension of Services

The Company may modify or add to all or any part of the Site and/or Services without any prior notice to Users.

In addition to as stipulated in paragraph 2 of Article 4 above, the Company may suspend or discontinue all or any part of the Site and/or Services in any of the cases listed below. While we will endeavor to notify Users in advance if possible, in the case of an emergency or any other unavoidable circumstances, we may inform Users promptly after the fact.

(1) While performing regular or emergency inspection or maintenance work on the Company’s computer system or network

(2) Stoppage due to computers, communication lines or the like, or other equipment trouble

(3) If the operation of the Site and/or Services becomes impossible due to fire, power outage, natural disaster or the like, or any event or circumstance of Force Majeure (as defined below).

(4) If the Company reasonably determines that it is necessary to suspend or discontinue the Site and/or Services for operational or technical reasons.

The Company shall not be liable for any damages caused to the User due to the suspension or discontinuation of all or any part of the Site and/or Services pursuant to this Article, except if and only to the extent that the damage is caused by the willful misconduct or gross negligence of the Company.

6. Warranty and Limitation of Liability

The Company does not guarantee the suitability or fitness for purpose for a User's specific purpose, or the accuracy, usefulness, legality, or completeness or the like, of the information provided through the Site and/or Services.

Users shall use the Site and/or Services at their own risk and responsibility, and the Company shall not be liable for any damages caused to any User due to the use of the Site and/or Services, including, without limitation, any disputes or the like arising between Users and any third parties including, without limitation, any Partner Companies, in connection with the use of the Site and/or Services, except if and only to the extent that the damage is caused by the willful misconduct or gross negligence of the Company.

If the Company is liable for any damages to a User in connection with the Site and/or Services, whether for breach of contract, tort, or any other reason, the scope of compensation shall be limited to the normal and direct damages actually incurred by the User, except if and only to the extent that the damage is caused by the willful misconduct or gross negligence of the Company. The Company shall in no event be liable for any consequential damages, loss of profits or revenues or damages from any other special circumstances, regardless of whether or not the occurrence of such damages was foreseen or could have been foreseen.

7. Force Majeure

In the event that the Company is unable to operate all or any part of the Site and/or Services due to war, civil war, epidemic, natural or other disasters, labor disputes, the establishment, revision, or abolition of laws, regulations, rules or the like by any government, or any other event or circumstance of force majeure (the foregoing, collectively or individually "Force Majeure"), including, without limitation, where posting Travel Information on this Site is prevented due to Force Majeure, the Company shall not be liable to any User or any third party in connection therewith.

8. Handling of Personal Information

The Company shall appropriately handle Users' personal information, including information related to a User’s identity, based on our separately-established privacy policy.

9. Service Termination

The Company may discontinue all or any part of the Site and/or Services by notifying users in advance.

10. Notices and Communications

All communications and notices regarding revisions of these terms and conditions, as well as notices regarding modifications, additions, suspensions, interruptions or discontinuations with respect to the Site and/or Services, and any other communications or notices from the Company to Users shall be made by posting to the Site. All such communications and notices shall become effective immediately upon the Company posting them.

11. Governing Law and Jurisdiction

These terms shall be subject exclusively to the jurisdiction of Japan, and the Tokyo District Court shall be the exclusive court of first instance with respect to all disputes between the Company and Users concerning the Site and/or Services.

12. Language

These terms and conditions are prepared in Japanese, but may be translated into other languages. In the event of any translation of these terms and conditions, the Japanese version is the original, and any and all translations into any other languages are provided for reference purposes only and shall not be interpretive of the content of these terms and conditions. If there is any discrepancy between the Japanese version and any translation of these terms and conditions, including, without limitation, in the interpretation or application or the like of these terms and conditions, the Japanese version shall prevail in all respects.
